Wills – The age to be able to make a Will in Manitoba is 18. Holograph Wills are permitted. Marriage revokes a Will unless it is made in contemplation and contains a declaration to that effect or a couple of other exceptions are met.
Power of Attorney for Property – This is referred to as a power of attorney or enduring power of attorney in Manitoba depending on whether it is intended to terminate on incapacity or survive incapacity. Manitoba legislation also references springing powers of attorney. However, this just refers to whether the power of attorney (regular or enduring) comes into effect on signing or some later date when specified conditions are met. The age to make a power of attorney of any kind in Manitoba is 18.
Power of Attorney for Personal Care – This is referred to as a health care directive in Manitoba. The age to be able to make one is 16. The document can set out directions with respect to health care decisions, appoint a proxy or both.
Estate Administration Tax (probate fee) – For applications on or after July 1, 2005, the fee is calculated as $70 for estate values of $10,000 or less, plus $70 for the next $10,000 of estate value up to $20,000, plus $7 per $1000 of estate value or part thereof on amounts over $20,000. No upper limit.
